This post provides an analysis of the European Union’s (EU) resettlement and humanitarian admission policy through the lens of the protection of personal data processed within the European Dactyloscopy Database (Eurodac) and the interoperability framework. Specifically, it discusses how the regime on the transfer of personal data of third country nationals should be respected when implementing a resettlement or humanitarian admission scheme based on the experience of the EU-Turkey Statement. The contribution highlights the legal challenges posed by the lack of a legal definition of the transfer of personal data in the EU’s data protection acquis. It concludes with a critique of the implementation of interoperable solutions between the new Eurodac and the interoperability components, on the one side, and third parties’ databases, on the other.
